GENERAL TERMS AND CONDITIONS – TRAVEL PACKAGES

Document prepared in accordance with Decree-Law 17/2018, Decree-Law 47/2018, Regulation (EU) 2016/679 (GDPR) and other applicable Portuguese legislation.

2. Key Concepts

Term Definition
Package Pre-organized set of transportation, accommodation, and/or other tourist services sold for a total price.
Client / Participant Individual contracting the Package.
Reservation Request submitted on the website, pending confirmation.
Voucher Digital document that guarantees the place after receipt of the initial payment.

3. Booking Process

  1. Online Pre-registration: No payment; chronological order determines the queue.

  2. Availability Confirmation: Instructions are sent to pay 50% of the package price per participant.

  3. Voucher & Pre-contractual Information: Issued after successful payment.

Subsequent Payments

  • 2nd Payment: 50% of the remaining balance up to 60 days before departure.

  • Payment Methods: SEPA transfer or MB Way. Bank fees are the responsibility of the client.

4. Prices, Changes, and Cancellations

4.1 Price Revision

The price may be revised up to 20 days before departure in case of:

  • Significant change in fuel costs;

  • Changes in taxes or fees;

  • Exchange rate fluctuations over 3%.

Any adjustment will be justified in writing.

4.2 Cancellation by the Client

≤ 30 days 90% of total price

If the spot is resold, the penalty is limited to non-recoverable costs.
Under unavoidable and extraordinary circumstances (Art. 26 DL 17/2018), the client may cancel without cost.

4.3 Cancellation by Às Voltas

Due to insufficient participants (minimum 10), safety issues, or force majeure: full refund or credit for another tour, at the client's choice.

5. Services Included / Not Included

Included (unless otherwise stated in the Technical Sheet):

  • Accommodation in double room with breakfast;

  • Guide;

  • Civil Liability Insurance.

Not Included:

  • Fuel, lunches, drinks, hotel extras, personal expenses, visas, flights, local taxes;

  • Personal travel insurance (mandatory; must cover motorcycle use and repatriation). Lack of valid proof prevents participation without refund.

6. Participant Conduct

  • Comply with traffic laws and Tour Leader instructions;

  • Do not overtake the guide, avoid alcohol during stages, respect schedules;

  • Use of certified helmet is mandatory;

  • Dangerous driving may result in immediate suspension, without refund.

7. Required Documentation

8. Data Protection and Image Use

  • Personal data processed only for contract execution and legal obligations (Art. 6.1(b/c) GDPR);

  • Tour photos/videos used for promotional purposes only with prior consent, revocable at any time;

  • Full Privacy Policy: asvoltas.pt/politica-de-privacidade

9. Responsibility of Às Voltas

  • Responsible for execution failures, except in cases of client fault, unforeseeable third-party actions, or force majeure;

  • Indemnities follow international treaties limits or, if absent, those of DL 17/2018;

  • Liability for death or bodily harm resulting from negligence is not limited.

10. Complaints and Disputes

  • Complaints: Electronic Complaints Book or e-mail up to 30 days after the end of the tour;

  • Adherence to the National Centre for Consumer Information and Arbitration (CNIACC) (www.cniacc.pt), without prejudice to access to courts.

11. Applicable Law and Jurisdiction

  • Portuguese law applies;

  • Competent court: Aveiro district, unless the consumer chooses the court of their domicile.

12. Acceptance

By paying the confirmation amount, the client declares having read, understood, and accepted these Terms, the Standardized Information Sheet, and the Privacy Policy.
